1. Services
NexSoft AI provides web development, SEO, graphic design, content writing, and digital marketing services. The exact scope of work for any project will be outlined in a proposal, contract, or written agreement between NexSoft AI and the client.
2. Project Timelines
Timelines shared during proposals are estimates based on the information available at the time. Delays caused by late client feedback, missing content/assets, or scope changes may affect the final delivery date.
3. Client Responsibilities
Clients are expected to provide necessary information, content, access (e.g., hosting, domain, ad accounts), and feedback in a timely manner to keep projects on track. Delays on the client’s end may impact project timelines and are not the responsibility of NexSoft AI.
4. Payments
- All projects require agreed payment terms outlined in the proposal or invoice (typically a deposit followed by milestone or completion payments).
- Late payments may result in paused work until the account is settled.
- Prices quoted are valid for the scope discussed; additional requests outside the original scope will be quoted separately.
5. Intellectual Property
- Upon full payment, clients own the final deliverables created specifically for their project (e.g., website code, designs, written content).
- NexSoft AI retains the right to showcase completed work in our portfolio, case studies, and marketing materials, unless otherwise agreed in writing (e.g., under an NDA).
- Any third-party tools, plugins, stock assets, or licensed software used in a project remain subject to their original licensing terms.
6. Results & Performance
For SEO and digital marketing services, we do not guarantee specific rankings, traffic numbers, or ad performance, as these depend on factors outside our direct control (search engine algorithms, market competition, platform policies). We commit to using industry best practices and transparent reporting.
7. Website Maintenance & Support
Unless a maintenance package is purchased separately, websites are handed over to the client after launch along with guidance on managing it. Ongoing bug fixes, updates, or changes after this point fall outside the original project scope.
8. Cancellations
Either party may cancel an ongoing project with written notice. Any work completed up to the cancellation date will be billed accordingly.
9. Limitation of Liability
NexSoft AI is not liable for indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of revenue, data, or business opportunities, beyond the amount paid for the specific service in question.
10. Third-Party Platforms
Where our work involves third-party platforms (Google, Meta, Shopify, WordPress, hosting providers, etc.), clients agree to comply with those platforms’ own terms of service. NexSoft AI is not responsible for changes, restrictions, or actions taken by these third parties.
11. Confidentiality
Both parties agree to keep sensitive business information shared during the project confidential, unless legally required to disclose it.
12. Changes to These Terms
We may update these Terms and Conditions periodically. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
